13. Publicity, Showcase Rights and Intellectual Property

All intellectual property rights in submitted entries and supporting materials remain vested in their respective creators or rights holders. Participation in the Awards does not transfer any ownership of intellectual property rights to HOVARLAY, its sponsors, partners, exhibitors, or any third party.

By submitting an entry to the HOVARLAY Nusantara Packaging Experience Awards 2026, participants grant HOVARLAY, its event partners, sponsors, exhibitors, and authorised representatives a perpetual, worldwide, non-exclusive, royalty-free licence to use, reproduce, publish, display, distribute, print, photograph, record, adapt, and communicate the submitted materials in any format for purposes relating to the Awards and for broader non-commercial promotional, educational, and showcase activities.

These purposes include, without limitation, competition-related communications, exhibitions, award ceremonies, conferences, trade shows, roadshows, demonstrations, press and media, publications, websites, social media, marketing materials, and related promotional activities, whether during or after the Awards programme.

For showcase, demonstration, and capability presentation purposes, submitted entries may be reproduced in both physical and digital formats, including packaging mock-ups, printed samples, display pieces, exhibition installations, showroom displays, presentation decks, and sales or client-facing materials.

Sponsors and partners may also reproduce submitted entries independently of the Awards programme for the purpose of demonstrating and showcasing their own capabilities, including but not limited to printing technology, inks, substrates, materials, finishes, and production processes. This may include the manufacture of sample packaging or mock-ups incorporating the submitted designs. Such use is strictly limited to non-commercial demonstration, marketing, exhibition, and sales presentation purposes relating to the sponsor’s or partner’s capabilities and shall not constitute commercial exploitation of the submitted design itself.

Where reasonably necessary for presentation or production purposes, HOVARLAY may coordinate with creators on the adaptation of presentation elements, including but not limited to colours, print treatments, finishes, materials, layouts, or display formats. Any such adaptations shall not affect ownership of the underlying intellectual property unless otherwise agreed in writing.

Where practicable, appropriate attribution to the creator will be provided.

For the avoidance of doubt, “commercial exploitation” of a submitted design refers to the manufacturing, licensing, sale, distribution, or other commercial use of the design as a standalone product or as part of a commercial product offering intended for end-user sale or third-party commercial distribution. Any such use shall require a separate written agreement between the creator or rights holder and the relevant third party.

14. Disqualification

The organiser may disqualify an entry if:

  • The entry is incomplete, late, or not submitted via the official portal
  • The entry fails eligibility requirements
  • The entry breaches these Terms, including plagiarism or IP infringement
  • The organiser reasonably believes there is fraud, cheating, vote manipulation, or other misconduct

15. Changes, cancellation, and technical issues

The organiser may update timelines, judging arrangements, or operational details if necessary due to circumstances beyond reasonable control. The organiser will communicate material changes on the competition website.

The organiser is not responsible for submissions that are not received due to technical issues outside the organiser’s reasonable control, including participant internet failures. Participants are encouraged to submit early.

16. Limitation of liability

To the extent permitted by applicable law, the organiser is not liable for indirect or consequential losses arising from participation in the competition, including loss of opportunity. Nothing in these Terms limits liability that cannot be excluded under applicable law.

17. Privacy

The organiser processes personal data in accordance with the Privacy Notice published on the competition website. The Privacy Notice forms part of these Terms.

18. Governing law and disputes

These Terms are governed by the laws of Singapore. Where disputes cannot be resolved amicably, parties agree to submit to the nonexclusive jurisdiction of the courts of Singapore, without prejudice to any mandatory rights under applicable law.
